These Terms of Service govern your use of the website webperts.com and your engagement with the services offered by Webperts, a digital agency based in Dubai, United Arab Emirates. These Terms are governed by the laws of the United Arab Emirates, including the UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions and applicable regulations in the Emirate of Dubai.
Webperts provides the following services: custom web design and development, mobile app development for iOS and Android, branding and brand strategy, digital marketing including SEO, paid advertising, social media management and email marketing, automation and AI-powered system development, and IT outsourcing and support.
The specific scope, timeline, deliverables, and pricing for each project are agreed upon through a separate written agreement, proposal, or quotation between Webperts and the client.
When engaging our services, you agree to provide accurate and complete information necessary for us to deliver the project. You agree to provide timely feedback, approvals, and required content within agreed timelines. Delays caused by the client may affect the project timeline, and Webperts will not be held responsible for such delays. You are responsible for ensuring that any content, images, or materials you provide to us do not infringe the intellectual property rights of any third party.
Payment terms are outlined in each individual project agreement or quotation. Unless otherwise agreed in writing, an advance payment is required before project commencement. Final payment is due upon project completion and before final delivery or launch. All prices are quoted in UAE Dirhams (AED) unless otherwise stated. Webperts reserves the right to suspend work on a project if payments are not received by the agreed dates.
If a client cancels a project after work has commenced, the advance payment or deposit is non-refundable. Webperts will invoice for any work completed up to the date of cancellation based on the agreed rate or scope of work. Refund requests for services already delivered will be evaluated on a case-by-case basis and are at the sole discretion of Webperts.
Upon receipt of full and final payment, Webperts assigns ownership of the final deliverables to the client, including website designs, mobile applications, and custom software. Webperts retains the right to display completed work in its portfolio and marketing materials unless the client requests otherwise in writing. All tools, frameworks, libraries, and methodologies used in the creation of deliverables that are proprietary to Webperts remain the intellectual property of Webperts. Third-party software, plugins, and licences remain subject to their respective licence agreements.
Both parties agree to keep confidential any proprietary, sensitive, or business-critical information shared during the course of a project. Webperts will not disclose client information to any third party without prior written consent, except where required by UAE law.
Webperts provides its services on a professional best-effort basis. To the maximum extent permitted under UAE law, Webperts shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability in any matter related to our services shall not exceed the amount paid by the client for the specific service in question.
Our services may involve integration with or recommendation of third-party platforms, tools, or services. Webperts is not responsible for the performance, availability, or terms of any third-party service. The client is responsible for reviewing and accepting the terms of any third-party platforms used in their project.
These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be referred to the competent courts of Dubai, UAE.
We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with the updated effective date. Continued use of our website or services after any changes constitutes acceptance of the revised terms.
